The rules of the road.

These Terms of Service (“Terms”) form a binding agreement between you and MechaniCar (“we”, “us”, “our”) covering your use of the MechaniCar website, web app, and native iOS & Android apps (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

MechaniCar is a private marketplace that connects car owners with independent repair shops. We are not a party to the repair work itself. We do not perform repairs, we do not employ the shops, and we do not collect or pay the repair fees on behalf of either party.

• All payments for repair work flow directly between the owner and the shop, off-platform.
• MechaniCar takes 0% commission on repair work. Whatever a shop quotes is what the owner pays them, in full.
• Our only revenue from shops is the optional Pro or Premium subscription fee (see Section 6).
• Quality, timing, warranty, and pricing of repair work are the shop's sole responsibility.

You must be at least 18 years old to use the Service. Shops must operate under a valid business license in their jurisdiction. We may suspend or terminate accounts that violate these requirements at any time.

• You're responsible for keeping your password secret.
• You may not impersonate someone else or create accounts on behalf of others without their consent.
• One person, one account. No shared logins, no resale of accounts.
• Repair shops must submit honest business information and pass our approval workflow before posting quotes.
• You may delete your account at any time from Settings → Privacy → Delete account.

You agree not to:

• Post unlawful, defamatory, fraudulent, threatening, hateful, or sexually explicit content.
• Upload media that infringes someone else's copyright or privacy rights.
• Send spam, run scrapers, reverse-engineer, or otherwise interfere with the Service.
• Attempt to circumvent our subscription fees (e.g., off-platform routing of users you found via MechaniCar).
• Use the Service for any illegal purpose.

Violations may result in immediate account termination — see Section 13.

• Shops may subscribe to Pro ($59.99/month) or Premium ($79.99/month) for expanded job visibility. Free shops see 1 job at a time; Pro sees 3; Premium sees unlimited.
• New shop accounts are eligible for a 30-day free trial of either paid tier. A payment method is collected upfront; you will not be charged for 30 days. You may cancel any time before the trial ends to avoid being charged.
• Subscriptions auto-renew monthly unless cancelled. Cancellation paths:
  • Web (Stripe): Settings → Subscription → “Manage subscription” opens the Stripe Customer Portal.
  • Android (Google Play): open the Google Play app → tap your profile → Payments & subscriptions → Subscriptions → MechaniCar → Cancel.
  • iOS (Apple): open Settings app → tap your Apple ID at the top → Subscriptions → MechaniCar → Cancel.
• Cancelling stops future renewals — you keep access through the end of the current billing period.
• All subscription fees are non-refundable, except as required by law or by Apple/Google's store policies.

• Quotes posted by shops are non-binding marketing offers until both parties accept and a booking is scheduled.
• Owners may accept multiple quotes for comparison but should only book the shop they ultimately choose.
• Accepted quotes form a contract between the owner and the shop. MechaniCar will retain a private record to help resolve disputes.
• Messaging between owners and shops is private. Sharing screenshots of someone else's messages publicly without their consent is prohibited.

Owners can rate shops with 1–5 stars and a written review after a job is marked complete. Reviews are visible publicly under your anonymous handle (e.g., “Owner-3742”). They are not visible under your real name. Reviews must be honest and based on a real completed transaction. We may remove reviews that violate Section 5 or that appear to be coordinated/fake.

You retain ownership of the photos, videos, voice notes, and text you post to MechaniCar. By posting, you grant us a non-exclusive, royalty-free, worldwide license to host, display, and transmit that content strictly as needed to operate the Service (e.g., showing your job to nearby shops, delivering a private message). We may remove content that violates these Terms.

You represent that you have the right to post what you post and that it doesn't infringe anyone's rights.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. MECHANICAR MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE QUALITY, RELIABILITY, OR FITNESS FOR ANY PARTICULAR PURPOSE OF THE SERVICE OR ANY REPAIR WORK PERFORMED BY SHOPS LISTED ON THE PLATFORM.

In particular, we don't warrant that:

• Any quote will be honored at the price posted once the shop physically inspects the vehicle.
• Any specific shop is licensed, insured, or qualified for your repair. Always verify credentials before authorizing work.
• The service will be uninterrupted or error-free.

TO THE FULLEST EXTENT PERMITTED BY LAW, MECHANICAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM (OR USD $100 IF YOU HAVE PAID NOTHING).

We may update these Terms from time to time. Material changes will be notified via email and an in-app banner at least 7 days before they take effect. Continued use after the change date constitutes acceptance.

We may suspend or terminate your account if you violate these Terms, if your shop fails approval, or if required by law. You may terminate at any time via Settings → Privacy → Delete account. Sections that by their nature should survive termination (e.g., content license for retained anonymized records, disclaimers, liability limits) survive.

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware. To the extent local consumer-protection laws require otherwise, those laws apply.

If you downloaded the iOS app from the Apple App Store, you and we acknowledge that these Terms are between you and MechaniCar only — not with Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. In the event of any failure of the app to conform to a warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple is a third-party beneficiary of these Terms and may enforce them against you.
